If you are part of a trade association, you may have heard recently that Republicans on the Hill will be seeking to set aside the FTC's amended Negative Rule under the Congressional Review Act, a process we have covered on our blog here. Despite various groups reporting this news, no one was able to confirm the veracity and/or timing of this development. Until now! This afternoon we spoke with a legislative assistant in Congresswoman Laurel Lee's (R-FL) office who confirmed that the Rule is very much on the House Energy and Commerce Committee's CRA docket and together with Senator Mike Lee (R-UT) (no relation), they will be introducing a "joint resolution of disapproval" to set aside the Rule. This staffer was not able to confirm when this would happen, which is understandable given the frenetic pace of activity currently swirling inside the Beltway, but assured it will happen soon.
